By accepting these terms and conditions (\u201cTerms<\/strong>\u201d) or otherwise enjoying any benefits of the Merchant Loyalty Programme (\u201cProgramme<\/strong>\u201d) on Grab Platform, you (also referred to as a \u2018user\u2019) agree to be automatically enrolled in the Programme as and when a Merchant makes available such a Programme on our platform:
1. Scope and Administration of the Programme<\/strong>
1.1. The Programme constitutes a commercial promotional and customer loyalty scheme sponsored, initiated, and administered exclusively by the participating merchant-partners (individually a \u201cMerchant<\/strong>\u201d and collectively the \u201cMerchants<\/strong>\u201d) in compliance with all prevailing promotional regulations.
1.2. Grab Company Limited (\u201cGrab<\/strong>\u201d, \u201cwe<\/strong>\u201d, \u201cus<\/strong>\u201d or \u201cour<\/strong>\u201d) acts solely as a technology infrastructure and solution provider to facilitate the execution of the Programme for the mutual benefit of the participating Merchants and eligible end-users (the \u201cUsers<\/strong>\u201d).
1.3. Where made available on the Grab platform, the deployment of each specific Programme by Grab is executed on an \u201cas-is\u201d basis pursuant to the explicit instructions, mandates, directives, and autonomous business decisions of the respective Merchant. The operation of, and participation in, any such Programme shall be governed solely and exclusively by the respective Merchant\u2019s terms, conditions, and promotional rules. The Merchant retains sole, ultimate, and absolute liability for the Programme, including but not limited to its legality, availability, fulfillment, and any disputes, claims, or losses arising therefrom.
2. Eligibility and Enrollment
You are automatically enrolled in the Programme for a Merchant once you have provided your consent to receive marketing materials from the Merchant in accordance with Clause 5 of these Terms or otherwise through our designated user flow on Grab Platform. You agree that your participation in this Programme is further subject to all the terms and policies published on https:\/\/www.grab.com\/vn\/en\/terms-policies\/<\/a>(\u201cStandard Terms<\/strong>\u201d). If any provision contained in these Terms is in conflict with, or inconsistent with any provision in the Standard Terms, these Terms shall prevail to the extent that this Programme is concerned. In the event that these Terms are silent on, or do not address a provision in the Standard Terms (including without limitation in respect of governing law and intellectual property ownership), the relevant provisions of the Standard Terms shall be applicable to this Programme.
Your participation in the Programme for a Merchant (and by extension, any Benefits (as defined hereunder) you may enjoy under the Merchant\u2019s Programme) will automatically terminate or expire at any time once you opt out of receiving marketing materials from the Merchant according to Clause 5 of these Terms or otherwise through our designated user flow on Grab Platform.
3. Benefits<\/strong>
Once you are enrolled in the Programme for a Merchant, you may enjoy certain discounts or offers (the \u201cBenefits<\/strong>\u201d) that are made available and funded by the Merchant, subject to terms and conditions prescribed by the Merchant (e.g., expiry dates, one-time use, or dine-in only requirements). Such terms may be shown with the Benefits. Your participation in the Programme for a Merchant (and by extension, any Benefits you may enjoy under the Merchant\u2019s Programme) will automatically terminate or expire at any time once you opt out of receiving marketing materials from the Merchant as specified in Clause 5 of these Terms or otherwise through our designated user flow on Grab Platform; or where the Benefits relate to collection of loyalty stamps or issuance of stamp-based reward vouchers, the applicable terms and conditions are available in your profile page (User Profile icon > Partner Loyalty Programme).
4. Grab\u2019s Role and Limitation of Liability<\/strong>
Grab is merely a platform service provider and is not responsible for any loss or damages arising out of the use of the Benefits or the goods\/services provided by the Merchant. Any claim by you with regard to the Merchant\u2019s products or services, including but not limited to food quality, pricing, service experiences or the Benefits offered by the Merchant, shall be made against and remain solely the responsibility of the Merchant. Grab does not guarantee that a Merchant will honor a specific discount and shall not be liable for a Merchant\u2019s refusal to provide the promised Benefit.
5. Personal Data<\/strong>
5.1. By participating in the Programme, users agree to the collection, use, processing, and disclosure of their personal data by Grab for the purpose of administering the Programme in accordance with Grab Privacy Notice at https:\/\/www.grab.com\/vn\/en\/terms-policies\/privacy-notice\/<\/a>.
5.2. By opting into the Merchant Loyalty Programme, you agree that both the Merchant and Grab may use your Grab registered personal data and relevant transaction information to send you promotions, offers, and event updates. These communications may be delivered via email, SMS, chat apps, or other digital channels and may include co-branded or merchant branded-content.
5.3. You may choose to opt out of marketing communications at any time through your account settings (Settings > Communications > Marketing communications from merchants > Your chosen loyalty merchants) by disabling the consent given to the Merchant of choice. If you opt out of receiving advertising, marketing, and promotional communications from us and\/or the Merchant(s), we may still send you non-promotional communications such as emails about your accounts or membership matters.
6. Disqualification and Amendments<\/strong>
Grab reserves the sole and absolute right to disqualify or reject any user deemed ineligible for the Programme under these Terms, the Standard Terms, or for having engaged in conduct that we consider inappropriate or unacceptable. We reserve the right to amend these Terms or terminate the Programme whenever deemed necessary, without prior written notice to any users.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t
